E Recovers Compensation against former Solicitor for delays

E had instructed a firm of Solicitors to act on his behalf. He had been rendered blind as a result of a condition at birth called Retinopathy of Prematurity which it was alleged was caused due to the administration of oxygen. Unfortunately E’s claim was not dealt with quickly, there were lengthy delays before any substantive work was undertaken and eventually the claim was struck out by the Court.

E then instructed Mintons and we successfully sued E’s former Solicitors with E recovering over £300.000.00 in compensation.

The claim was understandably not without risk primarily because for a professional negligence claim to be successful E has to prove that had his claim been dealt with adequately and in a timely fashion by his former Solicitors then on balance he would have recovered compensation from the hospital. The compensation which he recovered from his former Solicitors reflected the “loss of chance”.
